Richard Strauss, the composer behind the track in question died on 8th September 1949, so I’d presume that the copyright will (probably) expire this year (assuming I’m not misintepreting “the life of the author plus an additional 70 years”).
But since this work wasn’t originally created for Chicken Invaders (duh), I’d say there’s absolutely no point in adding it to the game.
